The overall purpose of the role is;

To handle a portfolio of claimant Clinical Negligence claims for clients, to generate fee income and contribute to the general success of the department.

To provide effective and high-quality legal and administration support to the Clinical Negligence Department

To provide assistance on Clinical Negligence claims with a range of damages between £3,000 and in excess of £1,000,000

Main Duties:

•Dealing with a Clinical Negligence caseload with an appropriate level of supervision
•Assisting Senior Fee Earners in dealing with complex Clinical Negligence matters
•Processing instructions in accordance with established procedures of both good practice and the Employer’s case management system
•Ensuring the telephone is answered and responded to appropriately, dealing with queries, taking messages and communicating the messages efficiently to the relevant person, maintaining confidentiality at all times
•Taking instructions and holding meetings with a multi-disciplinary team of experts for example, medical experts, case managers, care experts, forensic accountants and counsel
•Taking full, accurate details of the circumstances surrounding the client’s claim and preparing the client’s details for risk assessment
•Assisting with Pre-Action disclosure, to include obtaining records and arranging collation and chronology
•Analysing of evidence and research of legal issues on liability, causation and quantum
•Drafting pre-action letters, client correspondence, court documents and instructions to Counsel
•Preparing bundles of documents for medical experts, Courts, Counsel and others
•Assisting with all tasks necessary to conclude the case once court proceedings have commenced
•Securing early interim payments and appropriate rehabilitation
•Optimising your client’s settlement
•Dealing with internal queries and client correspondence, telephone calls and e-mails
•Producing regular reports relating to your workload including case analysis, concerns and outstanding issues
•Managing your own workload to deliver the financial, client and operational targets which will be measured in weekly and monthly KPI reporting
•Undertaking periodic reviews of the files you are dealing with in line with client requirements
•Implementing any recommendations made by your Line Manager following monthly reviews ensuring that these are dealt with promptly
•Maintaining accurate records on the Employer’s bespoke IT systems specifically the case management and billing systems
•Maintaining manual and computerised filing systems in respect of the cases that you are dealing with
•Understanding and exercising the obligations relating to clients’ monies and ensuring that fee earning work and billing complies with the Solicitors’ Accounts Rules and with the Employer’s financial guidelines and limits
•Using effective financial controls with particular regard to accurate preparation of invoices and the effective collection of monies on account
•Supporting the development of junior members of the staff within the department and share best practice ideas
•Being actively involved in business development and growing the Clinical Negligence Department’s client base
•Contributing to the marketing of the Clinical Negligence Department by drafting at least 1 website article every month
•Developing and maintaining good working relationships with clients and external institutions
•Providing general administration support including, sending emails, typing and photocopying
•Attending internal and external training as and when required
•Conducting legal research to ensure that your knowledge is up to date and to assist the Clinical Negligence Department in complex queries

General Duties and Responsibilities:
•Ensuring all documents are handled in accordance to the Employers Data Protection, Scan and Destroy Procedures
•Ensuring confidentiality and security of all documentation and information you have access to
•Maintaining high standards in the processing of client work, both in respect of professional standards and client care
•Adhering to all compliance guidelines, including but not limited to, Data Protection, Solicitors Regulation Authority and Pre-Action Protocol for the Resolution of Clinical Disputes
•Pro-actively co-operate with other departmental teams to support the smooth running of the Employer’s business
•Identifying system problems and suggesting improvements
•Complying with the Health and Safety Policy and Procedures at all times
•Abiding by the Policies and Procedures as set out in the Staff Handbook for the Employer
•Undertaking any other tasks/duties as may be reasonably required by the Employer
•Raise any concerns you may have regarding compliance to your Line Manager

Key Skills:
•Qualified Solicitor or Fellow of CILEx
•Achieved a 2:1 or higher Law degree or Graduate Diploma in Law
•Recent experience working within the field of clinical negligence
•Excellent literacy skills to ensure that all notes are legible and comprehensive
•Excellent written and verbal communication skills
•Excellent negotiation and objection handling skills
•Commitment to delivering excellent client care for each of our clients
•Computer literate in word and excel
•A professional attitude when working with colleagues, senior management, experts and clients

•Use of Proclaim Eclipse not essential but would be an advantage

Rate of Pay

£28,000.00 – £35,000.00 per year
